The Oregon Department of Education is updating the “Supporting Gender Expansive Students: Guidance for Schools” it put out two years ago. The section it published Tuesday, March 18, on athletics revises some of the language but does not substantially change ODE’s guidance.

“Schools are prohibited from excluding gender expansive students from participating in school athletics and activities that align with their consistently asserted gender identity if the basis of such exclusion is the student’s gender identity,” the updated section says.

Oregon and federal discrimination laws govern school activity participation, and those laws have not changed, according to a recent statement from OSBA.
