On Tuesday, Jan. 21, the Department of Homeland Security rescinded a policy in place since 2011 that discouraged Immigration and Customs Enforcement agents from taking actions in so-called “sensitive locations,” which included schools, hospitals and churches.

This does not affect Oregon’s sanctuary law provisions. Oregon schools are still prohibited from providing information or assistance to immigration officials unless required by a judicial subpoena. School leaders are advised to consult legal counsel before taking any action if contacted by immigration agents.

OSBA has created a resource document to provide some guidance for school leaders’ rights, roles and responsibilities. The federal enforcement approach is still evolving. OSBA will update the document and share further information as events warrant. All students in Oregon have a legal right to an education. OSBA and the Oregon Department of Education are focused on the welfare of all our children and their right to learn in a safe and welcoming environment.
